By far the most unpopular provision of the new health care reform law is the "individual mandate" requiring that by 2014 all but a very few Americans either have health insurance or pay an additional annual tax. Is that constitutional? Can the government really fine people for not buying something? The question may end up before the Supreme Court and, if it does, how might the government defend the constitutionality of the individual mandate? (more)

With its passage Sunday night of the bills H.R. 3590 -- the Senate Health Care Reform Bill -- and H.R. 4872 -- the Reconciliation Act of 2010 -- the U.S House of Representatives cleared the way for final enactment of the most sweeping reform of the U.S. health care system since the creation of Medicare in 1965. While the most impactful and controversial elements of the new law, like mandatory health insurance coverage, will not take effect until 2014, many people will see some important changes much sooner. We're closer than ever to winning a historic victory on health care. I should know: I served as Secretary of Labor under President Clinton during the last health care fight. And I'm sure that this time around we're within reach of passing a real health care reform bill—one that includes a public health insurance option. Unfortunately, some conservatives in the Senate are still pushing a "trigger" plan that would kill the public option through indefinite delay. (more)
