Eric Holder and the Department of Justice are in full control: When I visited Guantanamo earlier this month, I spoke with Brigadier General Timothy Lake, who took over as Deputy Commander for Joint Task Force Guantanamo in October. Lake reiterated several times that he and his staff have “zero input” and “zero influence” over the Obama administration’s transfer decisions. Instead, Lake said, they “provide information to the legal system” –- meaning the Department of Justice and the State Department. (more)

A plan to move the remaining detainees from Guantanamo Bay to a now-closed correctional facility in Illinois hit an unexpected roadblock when Congress refused to allocate funds for purchasing the prison, the New York Times reports. Without that funding, the White House says it will likely be unable to close the infamous military prison in Cuba until at least 2011. (more)

Last week, President Obama’s detention policy task force issued its preliminary recommendations on the prosecution of Guantanamo detainees. But as a Senate Judiciary Committee hearing on Tuesday afternoon revealed, there’s little consensus in Congress over where and how to prosecute terror suspects, or the likely consequences of the various alternatives... The intensifying debate over what to do with 241 detainees in the U.S. military prison at Guantanamo Bay, Cuba, has pushed the candidates for Virginia governor to address widespread speculation that at least two locations in the state, including Alexandria and Fairfax County, could receive prisoners. Although the three Democrats and one Republican broadly agree that detainees should be kept out of Virginia if possible, the issue has caused some state political leaders to divide along party lines over... Virginia Congressman Jim Moran (D) said in a Washington Post op-ed that his home district of Alexandria would be willing to host some of the terrorist detainees currently held at the military detention center at Guantanamo Bay, Cuba. Moran, after acknowledging the logistical and financial burdens hosting the prisoners would place on the community, nevertheless said that Alexandria would do its "civic duty" if asked by the Obama Administration. Alexandria has hosted terrorists before, serving as the site ... (more)

Althouse: I made a bet that Obama would not close Guantanamo.

Tuesday, May 05, 2009 12:45:07 PM GMT Monday, May 04, 2009 9:55:34 PM GMT
Here's my bet. And here's the sleight of hand that will keep Guantanamo open: House Democrats are refusing to pay for President Barack Obama's plan to relocate prisoners from the Guantanamo detention facility where enemy combatants are being held. Obama has signed an executive order to close the facility at Guantanamo Bay, Cuba, by early next year. But the Pentagon has yet to come up with a plan on where to put the 240 or so prisoners. Between 50-100 are likely to be sent to the United States. No ... (more)

SO, TELL ME AGAIN, WHO WERE THE RUBES? Civil liberties advocates blasted the Bush administration for subjecting Guantanamo Bay captives to indefinite detention and for denying them access to federal courts. The outrage over Guantanamo Bay among President Obama’s liberal base and among the populations of certain United States allies (particularly in Europe) probably explains why President Obama’s first set of executive orders included a provision directing the closure of the controversial detention fac... There were once 22 Uighur prisoners in Guantánamo. Muslims from China's oppressed Xinjiang province, they had all been swept up as human debris during "Operation Enduring Freedom," the U.S.-led invasion of Afghanistan that began in October 2001. The majority of these men were seized after fleeing to Pakistan from a run-down settlement in Afghanistan's Tora Bora mountains, which had been hit in a U.S. bombing raid. Initially welcomed by Pakistani villagers, they were then betrayed and sold to U.S. forces,... (more)

Obama Ordered Review: Gitmo Meets Geneva Convention Standards

The review was carried out on Obama's orders but by the military. That alone will will probably be enough for the left to dismiss it out of hand. Still, it must be considered bad news by the administration given it was released late on a Friday afternoon. I'm sure Andrew Sullivan, the various incarnations of Glenn Greenwald and the rest of the usual suspects will be apologizing to George W. Bush. Yep. Any minute now. Any. Minute. (more)

Court bars release of 17 Uighurs detainees into US

WASHINGTON – A federal appeals court on Wednesday ruled that 17 Turkic Muslims cleared for release from Guantanamo Bay must stay at the prison camp, raising the stakes for an Obama administration that has pledged to quickly close the facility and free those who have not been charged. In a showdown over presidential power, the U.S. Court of Appeals for the D.C. Circuit said a judge went too far last October in ordering the U.S. entry of the 17 men, known as Uighurs (WEE'-gurz), over the objections of t... (more)
