Washington (CNN) -- Accused foreign terrorists and war fighters in U.S. custody will have a more difficult time challenging their detention in the wake of a key ruling Tuesday by a federal appeals court. A three-judge panel concluded "wartime detention" limits the rights of foreign prisoners captured on overseas battlefield. The case involved an appeal by Ghaleb Nassar al-Bihani, a Yemeni captured in Afghanistan and held since 2002 at the Guantanamo Navy Base in Cuba. (more)

At least a dozen former Guantánamo Bay inmates have rejoined al-Qaeda to fight in Yemen, The Times has learnt, amid growing concern over the ability of the country’s Government to accept almost 100 more former inmates from the detention centre. The Obama Administration promised to close the Guantánamo facility by January 22, a deadline that it will be unable to meet. Senate Majority Whip Dick Durbin told CNN's John Roberts yesterday that he supports transferring detainees from Guantanamo Bay to prisons inside the United States. His position puts him at odds with Senate Leader Harry Reid and most of his Democratic colleagues, not to mention Republicans. The Senate voted 90-6 this week to stop detainees from being transferred to the United States. It also voted not to fund closing the facility until President Barack Obama actually has a plan. (more)
