The Obama administration’s longstanding pledge to close the detention facility at Guantanamo Bay just hit a major obstacle in the House, creating doubts over whether the detention facility can be closed this year — if at all. In case you missed the nonevent, the military prison for suspected terrorists and other assorted "enemy combatants" at Guantanamo Bay, Cuba, did not close today. It may be years before it does, assuming President Obama ultimately delivers on that promise. In any case, the policy of keeping people locked up indefinitely without trial will continue, supplemented by a policy of keeping them locked up even if they are tried and acquitted. (more)

Washington (CNN) -- Accused foreign terrorists and war fighters in U.S. custody will have a more difficult time challenging their detention in the wake of a key ruling Tuesday by a federal appeals court. A three-judge panel concluded "wartime detention" limits the rights of foreign prisoners captured on overseas battlefield. The case involved an appeal by Ghaleb Nassar al-Bihani, a Yemeni captured in Afghanistan and held since 2002 at the Guantanamo Navy Base in Cuba. (more)

Jan. 5 (Bloomberg) -- President Barack Obama’s top spokesman said the U.S. will suspend transfers of Guantanamo terrorist suspect to Yemen. Yemen is “not capable of handling” them now, Robert Gibbs told reporters at a briefing. “Right now, any additional transfers to Yemen is not a good idea.” (more)

At least a dozen former Guantánamo Bay inmates have rejoined al-Qaeda to fight in Yemen, The Times has learnt, amid growing concern over the ability of the country’s Government to accept almost 100 more former inmates from the detention centre. The Obama Administration promised to close the Guantánamo facility by January 22, a deadline that it will be unable to meet. The 91 Yemeni prisoners in Guantánamo make up the largest national contingent among the 198 being held. (more)

Senate Majority Whip Dick Durbin told CNN's John Roberts yesterday that he supports transferring detainees from Guantanamo Bay to prisons inside the United States. His position puts him at odds with Senate Leader Harry Reid and most of his Democratic colleagues, not to mention Republicans. The Senate voted 90-6 this week to stop detainees from being transferred to the United States. It also voted not to fund closing the facility until President Barack Obama actually has a plan. (more)
